1. Acceptance of Terms

By accessing or using DozzyWizard (“Service”, “we”, “us”, “our”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and DozzyWizard, operated from Istanbul, Turkey. Use of the Service implies full acceptance of these Terms.

2. Description of Service

DozzyWizard is an AI model aggregator platform that provides pay-as-you-go access to third-party AI models through our web app and API. We act as an intermediary between users and AI model providers. We do not own, operate, or control the underlying AI models.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are solely responsible for all activity that occurs under your account.
  • You must provide accurate and up-to-date information during registration.
  • You are responsible for keeping your API keys secret. Requests made with your keys are billed to your balance.
  • You must notify us immediately at contact@dozzywizard.com if you suspect unauthorized access to your account or API keys.

5. Payments and Billing

  • The Service operates on a pay-as-you-go basis. You are charged for usage as described on our pricing page.
  • All payments are processed through LemonSqueezy. By making a payment, you also agree to LemonSqueezy's terms and conditions.
  • All fees are non-refundable unless otherwise required by applicable law.
  • We reserve the right to change pricing at any time with reasonable prior notice.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

  • Generate, distribute, or facilitate content that is illegal, harmful, abusive, threatening, defamatory, obscene, or otherwise objectionable.
  • Harass, stalk, intimidate, or harm any individual or group.
  • Produce child sexual abuse material (CSAM) or any content that sexually exploits minors.
  • Promote, incite, or facilitate violence, terrorism, or hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • Spread misinformation, propaganda, or deliberately false content intended to deceive.
  • Engage in phishing, fraud, identity theft, or any deceptive practices.
  • Attempt to reverse engineer, scrape, or extract data from the Service in an unauthorized manner.
  • Circumvent, disable, or interfere with security features of the Service.
  • Use the Service to train competing AI models or services without prior written consent.
  • Violate any applicable local, national, or international law or regulation, including Turkish law.

We reserve the right to suspend or terminate accounts that violate this policy, without prior notice and without liability.

7. User-Generated Content and Responsibility

You are solely responsible for any content, prompts, inputs, or instructions you submit to the Service.

  • You represent and warrant that your inputs do not violate any law, regulation, or third-party rights.
  • DozzyWizard does not review, endorse, or take responsibility for user inputs or the AI-generated outputs resulting from them.
  • By submitting content to the Service, you acknowledge that such content, and any consequences arising from it, are entirely your own responsibility.
  • You agree to indemnify and hold DozzyWizard harmless from any claims, damages, or liability arising out of your inputs or use of the Service.

8. AI Output Disclaimer

The AI models accessible through DozzyWizard are provided by third-party providers. We make no representations or warranties regarding the accuracy, reliability, completeness, or suitability of any AI-generated output.

  • AI outputs may be incorrect, misleading, biased, or incomplete.
  • Do not rely on AI outputs for legal, medical, financial, or other professional advice.
  • DozzyWizard is not liable for any decisions made or actions taken based on AI-generated content.
  • Outputs generated through the Service do not represent the views or opinions of DozzyWizard.

9. Intellectual Property

  • DozzyWizard retains all rights to the platform, interface, branding, and proprietary technology.
  • You retain ownership of the content and prompts you submit, subject to the license below.
  • By submitting content to the Service, you grant DozzyWizard a worldwide, royalty-free, non-exclusive license to use, process, analyze, and store such content for the purposes of operating and improving the Service, including potential use in analytics, product development, and model training.

10. Data Use and Privacy

We collect and process your data as described in our Privacy Policy. By using the Service, you consent to such collection and processing. We may use your data, including usage patterns, for service improvement, analytics, and other purposes outlined in the Privacy Policy.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • DozzyWizard shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 30 days preceding the claim.
  • We are not liable for any actions, content, or outputs of third-party AI model providers.

13. Indemnification

You agree to defend, indemnify, and hold harmless DozzyWizard and its operators from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
